Private entrepreneur Malyar Violetta (hereinafter — “Agency”) invites any legal or natural person (hereinafter — “Client”) to conclude this Agreement on the terms of a public offer.
1. Subject of the contract
1.1. The agency provides recruitment services.1.2. The Client undertakes to pay for the services on the terms specified in this Agreement.1.3. The use of the Agency's website does not create an employment or agency relationship between the Client and the Agency.
2. Procedure for calculations
2.1. The client pays an advance in the amount of 10% to 20% of the cost of services. The advance is not refundable by the Agency in case of independent refusal of services by the client or violation of the terms of this agreement.2.2. The remaining amount is paid after the candidate leaves the job and has passed the adaptation period, but no later than 3-5 working days from the date of actual commencement of work.2.3. The advance is not refundable, except in cases of technical error, non-performance of the service, in cases of independent refusal by the customer of the services or violation of the terms of this contract.2.4. The client guarantees payment of the full amount upon acceptance of the candidate and completion of the adaptation period.
3. Mutual Obligations
3.1. The client is obliged to provide feedback on the submitted candidates within 3 working days.3.2. Interviews with candidates must be scheduled the same week the candidate was submitted, except for submissions on Thursday and Friday.3.3. The submitted candidate, even if other agencies are working on the vacancy, is considered to be assigned to the Agency.
4th. Warranties and Liability
4.1. The Agency does not guarantee exact deadlines for closing the vacancy. 4.2. In case of termination of the employment relationship of the candidate during the warranty period, the Agency provides a free guaranteed replacement. The duration of the warranty period is determined individually for each job.4.3. The agency is not responsible for the actions or decisions of the hired candidate.
5. Confidentiality and personal data
5.1. The Parties are obliged not to disclose confidential information obtained during the cooperation.5.2. All personal data are processed in accordance with the Law of Ukraine “On the Protection of Personal Data” and are used exclusively for recruitment purposes.
6. Force majeure
The Agency is not responsible for failure to perform or delay services in cases of force majeure, including martial law, natural disasters, quarantine restrictions and technical failures.
7. Dispute Resolution
All disputes are resolved through negotiations, and in case of failure to reach an agreement — exclusively in the courts of Ukraine in accordance with the legislation of Ukraine.
8. Final provisions
The contract is a public offer and enters into force from the moment of its acceptance by the Client (payment of the advance).
